Law No. 17/2018
Amendment to Law No. 10/2012 — “Regulating the Conditions of Entering,
Working and Gaming at Casinos”.

 

Employees of the concessionaire working at gaming tables, game machines, treasury counters, public relations, catering, cleaning, security and surveillance areas at casinos, as well as employees of junket promoters who work in casinos, are prohibited to enter the casinos except in the execution of duties and on the first three days of the Lunar New Year, as well as in the case of legitimate reasons as set out below.

  1. Entry for training purposes. The employees must hold a document issued by the institution which holds the course or training, containing the name of the course or training, the need to enter the casinos and the period concerned;

  2. Entry to the casino of concessionaire in exceptional cases, upon the approval by the concessionaire and the notification to the on-site inspectors of the Gaming Inspection and Coordination Bureau (DICJ) in the casino;

  3. Entry for purposes of academic research or associative activities, upon approval by the Director of the Gaming Inspection and Coordination Bureau (DICJ).

Penalties for violation
In terms of premiums and revenues of gaming
According to the Article 11 of Capital 2, prizes and other benefits of gaming won by persons who are prohibited from gaming shall revert to the Macao Special Administrative Region after deducting their losses.

Persons of gaming:
According to the Article 12, 13 of Capital 3: the person who does not comply with the law shall be punished for a crime of simple disobedience, pursuant to Paragraph 1, Article 312 of the Macao Penal Code. If a heavier penalty is not applicable, a fine of MOP 1,000 to MOP 10,000 will be imposed.

Concessionaire:
According to the Article 13 of Capital 3, the concessionaire of gaming will be punished with a fine of MOP 10 000 to MOP 500 000.

Self-Exclusion
According to the Article 6 of Capital I:

  1. Upon the application of an individual to exclude himself/herself from casinos, or upon the confirmation of an exclusion request made by his/her spouse, ascendant, descendant, or a family member related to him/her within the second degree of kinship by blood, the Director of DICJ may prohibit the person from entering all or some of the casinos for a maximum period of two years.

  2. The person concerned may apply for revocation at any time provided for in the preceding paragraph. The revocation will only come into effect 30 days after the application of repeal.

  3. The decision of revocation of prohibition according to the provisions of the preceding paragraph shall be notified by the DICJ to the person who requests the prohibition if it has not been the person concerned to request it.
